1. Acceptance of These Terms

A visitor who reads the website accepts these terms for the use of the site. A client who engages the company accepts these terms together with the written work authority for the file. Where a signed work authority conflicts with these terms, the signed authority prevails for that file only.

A person under the age of majority may use the site only with the involvement of a parent or guardian. A parcels file is opened in the name of an owner or an authorised representative, and the company may ask for evidence of authority before releasing any working page.

2. The Services Described

The company operates a land parcels desk covering six named services. Lot Survey Desk work builds a readable set of boundary lines from deeds, prior plats and field notes. Plat Filing Rounds carry a submittal set to the recording counter. Parcel Stewardship Weeks keep an owner file accurate over time. Boundary Walk Checks compare the recorded line with conditions on the ground. Easement Review Days trace the instruments that cross a parcel. Recording Office Evenings handle paperwork that must be lodged before a deadline.

The descriptions on the website are a summary, not a substitute for a written work authority. The company will confirm in writing what specifically is included in a file before work begins, and any item that is not listed in the authority is outside the engagement.

3. Scope of a Parcels File

Each parcels file is limited to the parcel or parcels named in the work authority. Work on a named parcel does not extend automatically to an adjoining holding, a shared access strip or a family division that has not been described. Where an adjoining parcel affects the work, the company will note the effect and ask whether the client wishes to extend the file.

A parcels file also carries a stated purpose. A file opened for a family transfer is not the same as a file opened for a lender, and a lender file may require stricter formatting, an updated signature and a separate indexing note. Where a client later needs the file for a different purpose, the company will review the working sheets and advise whether a fresh check is needed. A purpose stated on the work authority is the purpose the company will serve unless a written change is agreed.

The company does not provide legal advice, does not act as an attorney, does not issue a title opinion and does not guarantee the standing of any ownership claim. Where a question turns on law, the company will say so and will recommend that the client take advice from a licensed attorney.

4. Client Duties and Document Supply

A client is asked to supply the deed, the last recorded plat, any earlier survey and any easement instrument that the client holds. A client is also asked to disclose an ongoing dispute, a known encroachment or a proposed division that has not yet been recorded. Information supplied late or withheld can change the result of a survey or a filing, and the client carries that consequence.

A client is also asked to describe any known monument, well, septic field, utility corridor or culvert that might sit near a boundary. The company cannot avoid every buried service, and a warning from the client can save a field crew from a dangerous discovery. Where a client is unsure, the company will treat the area as sensitive and will note the caution in the field sheet.

The client confirms that the documents supplied may be read and used for the work. Where a third party holds a document, the client agrees to obtain permission before the company requests a copy. The client agrees not to ask the company to lodge at a recording counter an instrument that the client knows to be false or forged.

5. Quotations, Fees and Invoicing

A quotation is based on the documents available at the time and on the parcel area described. If the reading sheet reveals a larger area, a missing monument or an easement that needs research, the company will explain the difference and issue a revised quotation before continuing.

Recording fees, courier charges and county copy charges are billed at cost and are shown separately. Invoices are due within the period printed on the invoice. An overdue invoice may lead the company to pause work on a file until the balance is settled, though the company will always warn the client before pausing.

A quotation remains open for thirty days unless it states otherwise, because county fees and copy charges move. A retainer, where one is requested, is applied to the final invoice rather than held as a separate charge. A client who needs an invoice split between two parties should say so before the file opens, since a later split complicates both the bookkeeping and the record of who instructed the work.

6. Scheduling and Field Access

A boundary walk check needs lawful access to the ground. The client agrees to arrange entry or to obtain the permission of any neighbour whose land must be crossed. Where access is refused, the company will record the limitation and complete the work only to the extent the available ground allows.

Weather and county counter hours can shift a schedule. The company will give notice of a change when the change is known and will offer the next available date. The company does not treat a delay caused by weather, fire, flood or a county closure as a breach of these terms.

A recording office evening is scheduled against the closing hours printed by the county. If a county closes early for a holiday, a training day or an emergency, the company will move the lodging to the next open session and will tell the client the same day. The company keeps a small reserve of scheduled evenings for exactly this reason and does not treat the reserve as a promise of availability for a new file.

7. Boundaries and Professional Limits

A boundary walk check is an observation exercise. It records what is visible, what is displaced and where a fence or structure sits relative to a recorded line. It is not a guarantee that a court would resolve a boundary question in a particular way, and it does not create or extinguish an ownership right.

Where a corner monument is found to be missing, the company will describe the condition and recommend the next step. A re-set corner, a new drawing or a corrected plat may require a licensed surveyor and a fresh recording, and those steps are quoted separately if the client wishes to proceed.

An easement review day follows the same discipline. The company reads the instrument, sketches the corridor and records the width and route as written. The company does not widen a corridor to match a fence line, does not shift a corridor to avoid a structure and does not assume that a utility has the right it appears to use. Where the instrument and the ground disagree, the file states the disagreement rather than smoothing it over.

8. Recording and Filing Outcomes

A filing outcome depends on the county office. A recorder may reject a sheet for a signature, a seal, a margin or a description that does not match the index. The company checks the submittal set before it leaves the desk and corrects what it can, but the company cannot compel a county to accept a document.

If a filing is rejected, the company will explain the reason, prepare a corrected sheet where the fault lies within its work, and re-present the document. Any additional county fee is billed at cost. A rejection caused by a document supplied by the client is corrected at the client request and may attract an additional fee.

A plat filing round is not complete when the sheets leave the desk. It is complete when the stamped copies are back in the file, the instrument number is recorded and the client has been told what was lodged. The company keeps the receipt with the file and passes a copy to the client. A client who needs a certified copy later may be asked to pay the county charge for that copy, which is separate from the filing fee already paid.

9. Third Party Offices and Data

The company relies on public sources such as a county recorder index, an assessor roll and a planning department map. These sources can contain errors, can lag behind the ground and can be corrected without notice. The company works with the most reliable public copy available but cannot guarantee that a county source is complete.

Where a client asks the company to rely on a third party report, the company will note the reliance in the file so that a later reader understands which facts were taken on trust and which were verified directly.

The company does not accept an instruction to file an instrument before the source document has been read. A recording office evening for a document that the office has not seen would expose both the client and the company to a rejection and to a claim. The company will explain the delay and will offer the earliest session at which a complete set can be lodged.

10. Deliverables and Ownership

The client receives the deliverables named in the work authority, such as a signed survey note, a filed plat copy or a stewardship summary. The company keeps a working copy of every deliverable for its own file and for the protection of the client against a later question.

The client may use a deliverable for the purpose for which it was prepared and may share it with a lender, an attorney or a family member. The client may not resell a deliverable, publish it as a survey of another parcel or alter it in a way that hides the company note. The company retains copyright in its drawings and written notes.

A stewardship summary is a snapshot rather than a standing promise. It describes the file on the day it is written and does not promise that a county will hold the same view of the parcel later. A client who relies on an older summary for a new decision should ask the office for a fresh stewardship week before acting.

11. Cancellation and Stopping Work

A client may stop a file in writing at any time. The client pays for work completed and for any county fee already incurred. The company will hand over the completed portion and will explain what remains unfinished.

The company may stop a file where a client asks for something unlawful, where access is repeatedly refused or where an invoice remains unpaid after a warning. In that situation the company will return any document that belongs to the client and will keep only the copy needed for its own record.

A cancellation does not remove a public record. A plat already lodged stays in the county index, and a client who wants to correct such a record must pursue the correction through the proper instrument. The company will explain the route and prepare the correction if the client asks, but the company cannot recall a filed page.

12. Limits of Liability

The company provides its work with reasonable skill and care. To the extent the law allows, the company is not liable for an indirect loss, a lost bargain, a lost profit or a loss that flows from a source outside its control, including a change at a county office, a mistake in a public record or a third party obstruction of a field visit.

Where liability is found, the total amount recoverable from the company for a file is limited to the fee paid for that file. Nothing in these terms removes a liability that cannot lawfully be limited, and nothing is meant to reduce a right that a consumer holds under a law that applies.

The company carries general business cover and reviews it annually. A client who needs a specific certificate of insurance should ask before the file opens, and the company will supply the current document. The company does not provide a title insurance policy and does not stand in place of a title company.

13. Indemnity

A client agrees to hold the company harmless from a claim that arises because the client supplied a false document, withheld a material fact or gave an instruction that the client had no authority to give. This indemnity applies only to the extent of the client contribution to the claim.

The company agrees to tell the client promptly if a claim is received and to cooperate in a reasonable defence. A client who has fully and honestly disclosed the file history should have no reason to rely on this clause.

14. Confidentiality

The company keeps parcel information confidential and shares it only as a task requires, as described in the Privacy Policy. Staff sign an internal confidentiality note and access is limited to those who need it. A client should understand that a document lodged at a recording counter becomes public by law.

The company may refer to a completed file in a general description of its practice only where no owner name, parcel number or address is included. The company will not use a client name in promotional material without written permission.

A working drawing that a field crew carries to the ground is treated as confidential while it is in use. A printed copy is returned to the office at the end of a boundary walk check and is marked as a working copy. If a copy is lost, the company reports the loss to the client and, where the copy shows an access key or a gate code, recommends a change.

15. Acceptable Use of the Website

A visitor may read the pages, print a page for personal reference and link to the homepage. A visitor may not attempt to disrupt the site, copy the whole site for republication, present the company name as the work of another business or use the contact form to send unsolicited bulk messages.

The company may block an address that sends abusive traffic or automated requests. Blocking is a technical measure and does not affect any right that a genuine client holds to contact the office by email or telephone.

The company may use a short technical block for automated requests during a county filing deadline, when the office systems are busiest. The block is temporary and is lifted when traffic returns to normal. A visitor who is blocked while trying to send a genuine enquiry can call the office number and the matter will be resolved.

16. Intellectual Property

The written content, the page structure and the visual design of this website belong to the company. The company name and the desk names used on the site are the company identifiers. A visitor may quote a short passage with clear attribution but may not reproduce the whole site without written permission.

County instruments and public plats remain the property of the issuing office. Where the company reproduces a public record in a client deliverable, the reproduction is made for the client purpose only.

A client retains the right to the facts of the client parcel and to any document the client supplied. The company retains the analysis, the drawing style and the written structure of a deliverable. Where a client asks to reuse a drawing in another project, the answer depends on whether the reuse would imply that the company has surveyed the new ground. The office will give a clear answer in writing.

17. Disputes and Governing Law

These terms are governed by the law of the State of Utah, United States, without regard to a conflict of law rule. A dispute that cannot be resolved by discussion will be brought before a court of competent jurisdiction in Utah. Both sides agree to attempt a written resolution for a reasonable period before a formal step is taken.

A concern about a file can be raised by email at enquiry@kghhproperties.hair or by telephone at +15096969554. The company keeps a written record of every concern and will reply with the facts found in the file.

A small dispute can often be settled by a short meeting at the lot desk. The company prefers that route and will set aside time to read the file with the client present. A written note of the meeting is kept, and a point of agreement is recorded so that neither side has to reconstruct the conversation later.

18. Changes to These Terms

The company may revise these terms when a service changes or when a legal requirement shifts. The date at the top of the page shows the current version. A material revision will be noted on the homepage and, where a live file is affected, will be sent to the client by email.

Continuing to use the website or to work with the company after a revision means that the revised terms apply. A client who does not accept a revision may stop a file in the manner described above.

A revision never changes the fee agreed for a file that is already open. It also never imposes a duty on a client in a way that reaches back to work completed under the earlier version. The company treats a live file as governed by the terms in place when the work authority was signed.

19. Contact Details

Correspondence about these terms should be sent to KGHH Properties LLC at 457 N 400 W Unit 4, Cedar City - 84721-5146, United States (US), by email to enquiry@kghhproperties.hair or by telephone at +15096969554. The office keeps regular hours, and a message left outside those hours will be answered on the next working day.

The company is grateful that a reader has taken the time to review these terms, because a clear agreement allows the parcels desk to spend its hours on the ground rather than on avoidable confusion.

The office is open to a question about any clause above. A reader who is unsure how a term applies to a specific parcel is welcome to call +15096969554 or to write to enquiry@kghhproperties.hair, and the company will answer in plain words before any engagement begins.
